Campaigning for Cancer (Association Incorporated under Section 21)(“C4C“) provides the information contained on this website and the pages comprising the website (“website“) to users (“you“), subject to the terms and conditions set out herein (“the terms“). By accessing the website you are deemed to have read, understood and agreed to the terms. C4C may at any time modify any of the terms and such modification will supersede and replace any previous terms. The amended terms will be made available on the website. Each time you access the website, you agree to be bound by the terms, as modified from time to time.

Privacy Policy

  • Your privacy is extremely important to us. C4C maintains control of any names, mailing addresses, email addresses and credit card information submitted by users of its website. C4C may subcontract the distribution of materials and online credit card processing, but any such subcontractor would be strictly prohibited from sharing information gathered for/by C4C with any other organization or company. C4C does not sell, rent, or otherwise share its contact list or database.
  • C4C uses the information it collects to measure the number of visitors to the different sections of our site, and to help us make our site more useful to visitors. If you visit our site to place an order, we collect and store your name, mailing address, and credit card information for processing publication or merchandise orders that you request online.
  • If you identify yourself by sending email, you may decide to send us personally identifying information, such as name and surname, birth date, gender, country of residence, email address, IP address, and ID number / passport number. C4C does not knowingly collect or maintain information on person under 18 years old, except such information provided by a parent or legal guardian.

Disclosure of Patient information Policy

  • All information relating to your health status, treatment or stay in a health establishment (as defined on the National Health Act No. 61 of 2003, as amended from time to time (“NHA”)), is treated by C4C as confidential. C4C will not disclose any such information unless (a) you have consented thereto in writing; (b) a court order or any law requires that disclosure; or non-disclosure of the information represents a serious threat to public health.
  • Please note however that a health worker (as defined in the NHA) or any health care provider(as defined in the NHA) (“health care provider “) that has access to your health records may disclose such personal information (as defined in the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) to any other person, health care provider or health establishment (as defined in the NHA”) as is necessary for any legitimate purpose within the ordinary course and scope of his or her duties where such access or disclosure is in your interest.”
  • Please also note that a health care provider may examine a your health records for the purposes of _(a)treatment with the authorisation of the user; and (b) study, teaching or research with the authorisation of the user, head of the health establishment concerned and the relevant health research ethics committee. If the study, teaching or research contemplated in subsection (b) reflects or obtains no information as to the identity of the user concerned, it is not necessary to obtain the authorisations as aforesaid.

C4C Conflict of Interest Policy

  • C4C formulates its public policy based on thoughtful policy analysis that is focused on the best interest of cancer survivors and their families. C4C’s conflict of interest policy prohibits consideration of any donor interests “in formulating a C4C public policy or taking a particular stance…the motivating factor behind any C4C public policy position shall be what is in the best interest of the cancer survivorship community as a whole, not what will serve the needs of any proprietary or special interest.” In addition, C4C does not endorse proprietary products such as a particular brand-name pharmaceutical.
  • C4C will endorse the expansion of cancer treatment options that are recognized by South African and international government administrations established to protect the public health by ensuring the safety, efficacy, and security of human and veterinary drugs, biological products, and medical devices as safe, potentially effective and that meet the interests of cancer survivors. And “C4C shall make general public statements in support of the interests of cancer survivors, regardless of whether the position is supportive of, neutral to, or in contradiction to the interests of a donor.”
  • In keeping with the above stated ethics regarding conflicts of interest, C4C currently does not have advertisers, website sponsors or e-commerce affiliates. C4C does receive funding for the organization from a variety of sources. All donors are informed of C4C’s Conflict of Interest Policy and understand that their donations will have no influence over the content or design of C4C’s website.

Quality Control

C4C reviews all content and materials presented on its website to ensure that the information is accurate, current and of the highest quality. C4C maintains strict control over all information posted to its site.

Authorship

Most of the information posted to the website is original C4C material; however, C4C may post material authored by individuals or organizations other than C4C. C4C will only exhibit materials from sources known to be reputable and responsible.   • C4C shall be shall be entitled from time to time, by giving notice to you to vary its physical address for service to any other physical address within the Republic of South Africa, and to vary its facsimile address for service to any other facsimile number.

 

General

  • The terms constitute the sole record of the agreement between you and C4C in relation to the subject matter hereof. Neither you nor C4C shall be bound by any express tacit or implied representation, warranty, promise or the like not recorded herein.  These terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and C4C in respect of the subject matter hereof.  No indulgence or extension of time which either you or C4C may grant to the other will constitute a waiver of or, whether by estoppel or otherwise, limit any of the existing or future rights of the grantor in terms hereof, save in the event or to the extent that the grantor has signed a written document expressly waiving or limiting such rights.
  • C4C shall be entitled to cede, assign and delegate all or any of its rights and obligations in terms of these terms.
  • Should C4C be prevented from fulfilling any of its obligations to you as a result of any event of force majeure, then those obligations shall be deemed to have been suspended to the extent that and for as long as C4C is so prevented from fulfilling them and your corresponding obligations shall be suspended to the corresponding extent. In the event that force majeure continues for more than fourteen days after it has fist occurred then C4C shall be entitled (but not obliged) to terminate all of its rights and obligations in terms of or arising out of these terms by giving notice to you.  An “event of force majeure” shall mean any event or circumstance whatsoever which is not within the reasonable control of including, without limitation, vis major, casus fortuitus, any act of God, strike, theft, riots, explosion, insurrection or other similar disorder, war (whether declared or not) or military operations, the downtime of any external telecommunications line, power failure, international restrictions, any requirement of any international authority, any requirement of any government or other competent local authority, any court order, export control or shortage of transport facilities.
  • These terms shall be governed by and construed in accordance with the laws of the Republic of South Africa without giving effect to any principles of conflict of law. You hereby consent to exclusive jurisdiction of the Witwatersrand Local Division of the High Court of South Africa in respect of any disputes arising in connection with the service/s referred to herein, or the terms or any matter related to or in connection therewith.

TERMS AND CONDITIONS FOR UPLOADING PICTURES AND OTHER USER CONTENT TO CAMPAIGNING FOR CANCER WEBSITE

  • By uploading / submitting photograph(s), video(s), comment(s) and any other accompanying materials (collectively the “User Content”) onto the Campaigning for Cancer Website (“the Website”) , and any of its mini-sites, you hereby agree, understand and confirm that:
  • you grant Campaigning for Cancer (“the Organisation”) free of any charge, an unrestricted and unlimited non-exclusive licence to display, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and/or sub-license the User Content;
  • the Organisation may make the complete User Content or any part thereof available to its staff, including volunteers or contracted staff, the public, corporate partners, agencies (including advertising agencies) and/or third party organisations (including other Non-Profit organisations) working with the Organisation via an electronic information storage or retrieval system such as a photo library that currently exists or comes into existence after the date on which you download the User Content to the Website or by means of electronic or data transmission (i.e. email). The Organisation shall also have the right to disclose your identity to any third party who  claims that any User Content that you may have uploaded onto the Website constitutes a violation of such third party’s rights, including their intellectual property or privacy rights;
  • the Organisation has unrestricted use of the User Content in connection with the Organsation’s various activities and charitable purposes such as its publications, presentations, talk/event materials, websites or marketing materials, products and national/local press for publicity, promotion and/or advertising campaign purposes;

you represent and warrant to the Organisation that:

  • you are 18 years of age or older;
  • you own all rights to the User Content or otherwise have the right to submit the User Content to the Organisation;
  • the User Content does not violate or infringe upon the rights of any third party (including, any rights of copyright, trademark, publicity or privacy);
  • all persons identified in the User Content have consented to the submission of the User Content to the Organisation and the further use of the User Content as contemplated herein; and
  • the Organisation’s use of the User Content in the manner contemplated above and the rights and licenses granted hereunder do not, and will not, violate any right of, or conflict with or violate any right or commitment made to any third party and no consent or authorization from any third party is required in connection with such use;
  • you hereby agree to defend, indemnify and hold harmless the Organisation from and against any losses and all claims by third parties resulting from the breach of any of the foregoing representations or warranties;
  • the User Content you upload is your own original work (and you have all necessary rights to provide the User Content to the Organisation upon these terms and conditions), is not defamatory and does not infringe any South African law or the law of any country from which the User Content is uploaded. You further confirm that you have the express consent of any persons who are identifiable in the User Content to publish the User Content onto the Website: Provided that if any of those persons are under 18, you have obtained the express consent of their parents or guardians to publish the User Content onto the Website;
  • the User Content is not obscene, offensive, hateful or inflammatory, does not promote violence or discrimination based on race, sex, religion nationality, disability, sexual orientation or age;
  • you shall not hold the Organisation liable for any loss or damage resulting from the use or inability to use the User Content and from any claims by any third party concerning the recording, uploading, publishing or use of the User Content. You hereby agree to defend, indemnify and hold harmless the Organisation against any claims from a third party concerning copyright or other intellectual property ownership rights relating to the User Content;
  • the User Content does not contain any material that may be harmful to the operation of computer equipment, such as viruses and the like. The Organisation will not provide insurance or financial cover in any event for any loss or damage of any User Content provided to it;
  • the Organisation, at its sole discretion, reserves the right to refuse the publication of any User Content and to remove any User Content at any time from the Website. You may not upload any User Content in respect of which you do not own the copyright.

  • Commentary and other materials posted on the Website do not amount to advice on which reliance should be placed. The Organisation excludes any liability that may arise from any reliance on such materials by you or anyone to whom you provide the material. Material displayed on the Website is published without any guarantees, conditions or warranties by the Organisation as to its accuracy.

Access to the Website is permitted on a temporary basis and the Organisation reserves the right to withdraw or amend the service provided on some or all parts of the Website without prior notice.   • The Organisation or the Organisation’s licensee, as the case may be, is the owner of all intellectual property and material published on or relating to the Website and no licence in respect of any such property is granted to you save as expressly set out in these terms and conditions. All materials published on this Website are protected by universal laws and treaties. All such rights are reserved. You may print and download extracts of any page(s) from this Website for your personal reference only but you may not in any way modify the paper or digital copies of any printed or downloaded materials and you may not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
  • The status of the Organisation (and that of any identified contributors) as the author of material on the Website must always be acknowledged. You may not use any part of the materials on the Website for commercial purposes without obtaining the requisite licence to do so from the Organisation or its licensors, as the case may be. Should you print, copy or download any part of the Website in breach of these terms and conditions, you shall immediately be suspended from accessing the Website and you shall be ordered, at the option of the Organisation, to return or destroy any copies of the materials you have made.

Viruses, Hacking and other Offences

You may not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful to the Website. You may not attempt to gain unauthorised access to the Website, the server on which the Website is stored, or any server, computer or database connected to the Website. You may not attack the Website via a denial-of-service attack or a distributed denial-of service attack. The Organisation shall report any such breach to the relevant law enforcement authorities and will co-operate with the authorities by disclosing your identity to them. In the event of such a breach, you shall immediately be suspended from accessing the Website.

By submitting your photo to the Campaigning for Cancer page (including its Facebook wall) on Facebook (the “Page”), you hereby agree and consent to the Organisation and its affiliates, subsidiaries, agencies (including advertising agencies) and parents using the submitted photograph(s), video(s), comment(s) and other accompanying materials for advertising, marketing, promotion and other commercial and business purposes in accordance with these terms and conditions.
